These Terms & Conditions (“Terms”) govern your use of marykilpatrickart.com (the “Site”) and any purchase of original paintings or limited-edition prints from Two Twisted Sisters LLC, doing business as Mary Kilpatrick Art (the “Company”). By accessing the Site, submitting an inquiry, or placing an order, you agree to these Terms.

1. The Company & the Site

The Site is operated by Two Twisted Sisters LLC, doing business as Mary Kilpatrick Art, based in Bend, Oregon. All original paintings and limited-edition prints offered on the Site are created by the artist Mary Kilpatrick.

2. Products

Original Paintings

Each original painting is a unique, one-of-a-kind physical work. Once the physical original is sold, that specific object is no longer available. Every original includes a signed Certificate of Authenticity. Availability is confirmed upon inquiry. Works under active inquiry may be held for up to 48 hours; the first buyer to complete payment secures the physical work.

Sale of an original painting transfers ownership of the physical object only. The artist and the Company retain all copyright and reproduction rights, including the exclusive right to create and sell limited-edition prints (and any subsequent editions) of that work.

Limited-Edition Prints

The first edition of each print is limited to a maximum of 100 numbered prints. Once that edition reaches 100, it closes. Each print in the first edition is accompanied by a signed and numbered Certificate of Authenticity stating it is from the first edition. Prints are produced to order on fine-art papers (including Somerset Velvet, Hot Press, and Cold Press) using archival inks.

The Company and the artist expressly retain the right to create and sell additional editions of the same image in the future (for example, a Second Edition, Open Edition, or edition in a different size or medium). Any future edition will be clearly distinguished from the first edition.

3. Pricing, Payment & Taxes

Prices are listed in U.S. dollars and are subject to change until an order is confirmed and paid. Full payment is required before production or shipping begins. Payments are processed securely through Stripe.

Oregon does not impose a general sales tax. However, sales tax may be collected on shipments to other states if economic-nexus thresholds are met. Any applicable tax will be calculated at checkout or confirmed before final payment when required by law. The buyer is responsible for any local taxes, duties, or customs fees that may apply.

4. Shipping

Prints ship worldwide via insured carrier with tracking. Production typically takes 3–5 business days after payment. Original paintings ship within the United States (estimated 3–7 business days after payment and packaging), also via insured carrier with tracking and declared-value coverage. Signature may be required for higher-value shipments.

Packaging standards:

Shipping costs, when applicable, are calculated based on size, weight, and destination and are confirmed before final payment. Risk of loss passes to the buyer upon delivery (or upon carrier acceptance if the carrier requires signature release).

International shipping is not currently offered. Please contact us if you have a special request.

5. Returns, Refunds & Cancellations

Original Paintings

Because each original painting is a unique, one-of-a-kind work, all sales of original paintings are final once payment is completed and the work has shipped.

Limited-Edition Prints

Limited-edition prints are produced to order. Orders may be cancelled for a full refund only before production begins.

Once production has started or the print has shipped, sales are final. The only exceptions are:

In either case, the buyer must notify us in writing within 48 hours of delivery and provide clear photographs of the issue (and of the packaging if the claim is for transit damage). We will arrange a replacement or refund as appropriate.

We make every effort to display colors and details accurately on the Site. However, due to differences in monitor calibration, screen settings, lighting conditions, and the nature of fine-art paper and archival inks, the physical print may vary slightly from what appears on your screen. These normal variations are not considered defects and do not qualify for return or refund.

If a print arrives with a significant manufacturing defect or is materially different from the artwork as reasonably represented on the Site, please contact us within 48 hours of delivery with clear photographs. We will review the claim and, if warranted, arrange a replacement or refund.

General Terms

We reserve the right to cancel any order and issue a full refund if a work is unavailable, significantly misdescribed, or if we are unable to fulfill the order for any reason.

Unless the return is due to our error or transit damage covered above, the buyer is responsible for all return shipping costs and must insure the work for its full value during return transit.

6. Intellectual Property

The buyer of an original painting or limited-edition print receives ownership of the physical object only. No copyright or reproduction rights are transferred to the buyer.

All copyright, reproduction rights, moral rights, and related intellectual-property rights remain exclusively with the artist Mary Kilpatrick and/or Two Twisted Sisters LLC. This includes the exclusive right to create limited-edition prints, subsequent editions, licenses, and any other reproductions or derivative works.

Limited Personal Photography. The buyer may take personal photographs of the artwork as installed in their private residence for non-commercial purposes only (for example, sharing on personal social media). Any other copying, scanning, reproduction, digitization, or creation of derivative works — whether for personal or commercial use — is prohibited without prior written permission.

Sale of an original painting does not transfer any print or reproduction rights. The artist and the Company retain the right to produce the first limited edition (maximum 100) and any future editions of the work.

Images of the artworks on this Site are protected by copyright and may not be used or reproduced without permission.

7. Authenticity

Every original painting and every limited-edition print is accompanied by a signed Certificate of Authenticity that documents title, medium, dimensions (where applicable), and edition information. This certificate confirms authenticity and provenance of the physical object only. It does not transfer any copyright or reproduction rights.

8. Limitation of Liability

To the fullest extent permitted by law, the Company, the artist, and the Site shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any purchase. Our total liability for any claim related to a purchase shall not exceed the amount you paid for the specific artwork in question.

9. Governing Law & Disputes

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Oregon. We encourage you to contact us first so we can attempt to resolve any issue informally.

10. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will reflect the current version. Continued use of the Site or placement of an order after changes constitutes acceptance of the revised Terms.
